Advice needed-Paypal dispute

I recently took delivery of a pair of RAF escape boots which I had bought on Ebay. They were described as size 9, but when I tried them on it was obvious they were far too small, most likely a size 7. The boots do not have a size marked on them. I contacted the UK seller who was immediately hostile when I asked for a full refund. So I opened an item not as described dispute with Paypal and this forced the seller to initially agree to a refund. He would not refund me for my return postage. He is requesting the boots returned before he will issue a refund, but I am unhappy with this. I have searched the Ebay site for the correct protocol to follow here. Does anyone know what is correct? Deeb where are you?

I'm awake. :)

I think it's safe to return the boots first, it's usual on eBay. If the dispute escalates to a claim, PayPal state the following:

  • PayPal may require the buyer to post an item that the buyer claims is Significantly Not as Described back to the seller (at the buyer’s expense), and PayPal may require a seller to accept the item back and refund the buyer the full purchase price plus original shipping costs.

Originally you would have had to return them for a refund but as he is now being stubborn then I guess let PP deal with it. I have noticed too many RAF Escape Boots appearing both on eBay and through various dealers that are the post-war type..same design but different markings (if present) and often later non-AM type zips. These style of boots were still being issued/worn well into the 1960's. I would like a nice pair (and to have the elusive knife intact!) but would need to see a pair in the flesh beofre buying.

Paypal! As a buyer you have the ball in your court. Seller should be aware of this and go out of his way to appease you. Your Item Not as Described hit the nail on the head. I am not sure how long you will have to wait for the funds. They will freeze his funds, prevent further use if the funds are not in the account. I waited 3 months for Seller Protection with the AWOL Perry. But that all worked out VERY well for me in the end. :oops: The agro in the interim is what you have to endure. Best of luck with it...and as stated... name and shame!

Yes. I would avoid the seller. He was somewhat unpleasant in his emails. I have decided now to keep the boots as a friends wants them, which avoids having to post them back. I have left him neutral feedback.

Why only leave him a neutral? He clearly needs to learn not to try it on with his customer(s) and a negative would have got the message through and warned off other potential buyers.

Yes, you are right Paul, perhaps negative would have been more appropriate in the circumstances. Nevertheless anyone who reads his feedback will notice he is not a totally reliable seller. I hope people here will think twice before buying from him.
